Please read these Terms of Service ('Terms', 'Terms of Service') carefully before using the Yiki Sam website (the 'Service') operated by Yiki Sam Enterprise ('us', 'we', or 'our'). All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service Changes.

LIMITATION OF LIABILITY AND ASSUMPTION OF RISK

To the fullest extent permitted by applicable law, all products are provided on an "as is" basis without any express or implied warranties, representations, guarantees, or conditions, including but not limited to warranties of merchantability, fitness for a particular purpose, durability, or suitability for any specific use.

Customers acknowledge that the use of any product purchased from us is entirely at their own risk. Yiki Sam Enterprise shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, losses, costs, expenses, claims, or liabilities arising from or related to 

  • The use, misuse, improper use, modification, alteration, repair, storage, or handling of any product;
  • Failure to supervise a child while using the product;
  • Failure to inspect products for wear, damage, or loose components;
  • Allergic reactions, skin sensitivities, or irritation arising from contact with product materials;
  • Choking incidents, suffocation, entanglement, ingestion, injury, illness, accidents, or other harm resulting from the use or misuse of the product;
  • Normal wear and tear, product deterioration, or accidental damage after delivery;
  • Use of products in a manner inconsistent with their intended purpose.

To the fullest extent permitted by applicable law, Yiki Sam Enterprise's total aggregate liability for any claim relating to any product shall be limited to the amount paid by the customer for the specific product giving rise to the claim.

Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law.

PRODUCT CARE AND USAGE INSTRUCTIONS

Our products are handcrafted and should be handled with reasonable care to preserve their quality and appearance.

To prolong the life of your hair accessories, we recommend:

  • Storing products in a cool, dry place away from direct sunlight and excessive humidity.
  • Avoiding contact with water, perfumes, lotions, oils, hairsprays, and other chemicals.
  • Avoiding excessive pulling, twisting, bending, or rough handling.
  • Inspecting products regularly for signs of wear, damage, loose parts, or deterioration.
  • Discontinuing use immediately if any part of the product becomes loose, damaged, or unsafe.

Yiki Sam Enterprise shall not be responsible for damage arising from improper handling, misuse, normal wear and tear, accidents, alterations, or failure to follow the above care instructions.

PRODUCT SAFETY NOTICE

Our hair accessories are intended for decorative use only and are not toys.

Certain products may contain small parts, including but not limited to clips, embellishments, beads, ribbons, elastic components, or decorative attachments that may present a choking, suffocation, entanglement, or injury hazard.

For the safety of children:

  • Adult supervision is required at all times while products are being worn or handled by infants and young children.
  • Products should be removed before sleeping, napping, bathing, swimming, travelling in a car seat for extended periods, or any unsupervised activity.
  • Products should never be placed in a child's mouth.
  • Customers are responsible for determining whether a product is suitable for the intended user.

By purchasing and using our products, you acknowledge and accept the risks associated with the use of children's hair accessories and agree to use the products responsibly and under appropriate supervision.

COLOUR AND HANDMADE PRODUCT DISCLAIMER

We make every effort to display product colours and images as accurately as possible. However, actual colours may vary slightly due to differences in device screens, monitor settings, lighting conditions, photography, and individual perception of colour.

Such variations shall not be considered a defect, fault, or basis for refund, exchange, or compensation.

All products are handcrafted in small batches. As a result, slight variations in fabric placement, pattern alignment, measurements, shape, stitching, trimming, embellishment placement, and overall appearance may occur.

These natural variations are inherent characteristics of handmade products and contribute to the uniqueness of each piece. Minor variations shall not be regarded as defects and do not affect the functionality or intended use of the product.

PRICES AND PAYMENT

All prices provided on the website are in Malaysian Ringgit. 

For payment of item on website, you confirm that the payment method including credit or debit card that is being used is yours or that you have authorized by the owner/s for the usage of the payment method. All credit or debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your credit or debit card refuses to authorize payment to us, we will not be responsible or liable for any delay or non-delivery.
